An NRI can buy residential property in India without RBI permission, fund it from an NRE or NRO account, and sign through a registered Power of Attorney without flying in. Six steps, and the three people get wrong
Step 1
You are already allowed to buy
An NRI or OCI can acquire residential or commercial property in India under FEMA with no RBI permission required. Agricultural land, plantation property and farmhouses are the exception — those need specific approval and are generally not available to you.
Most-asked question, and the answer is simply yes.
Step 2
Fund it from NRE, NRO or FCNR
Payment must come through normal banking channels — an inward remittance or a balance in your NRE, NRO or FCNR account. Traveller's cheques and foreign currency notes are not acceptable routes.
Keep the remittance trail clean. It is what makes repatriation possible later.
Step 3
Indian banks will lend to you
NRI home loans are available from most major Indian lenders, typically repayable through NRE/NRO remittance or rental income. Tenure is usually shorter than a resident's.
Step 4
You do not have to fly in — Power of Attorney
A specific Power of Attorney, executed before the Indian consulate in your country or notarised and apostilled locally, then adjudicated and stamped in Karnataka, lets a trusted person register on your behalf.
This is the step people get wrong. A general POA is usually refused; it must be specific to the transaction, and it must be stamped in the state of registration.
Step 5
TDS — you are the deductor when you buy
Buying from a resident seller at ₹50 lakh or above, you deduct 1% TDS under section 194-IA and deposit it. If you ever buy from another NRI, the rate is materially higher and runs under section 195.
Buyers routinely miss that this obligation is theirs, not the seller's.
Step 6
Repatriating the money later
Sale proceeds of up to two residential properties can be repatriated where the purchase was funded through NRE/FCNR or inward remittance. Beyond that, and for NRO balances, the USD 1 million per financial year route applies, with a CA's Form 15CB and Form 15CA.
Plan the exit at purchase. The funding route you choose today decides what you can take out.
